Remember that, if the product you have purchased is in perfect condition, the commercial establishment is under no obligation to exchange it or give you a refund.
However, some establishments will do so. If so, this will be stated in their offers and advertisements or at the establishment itself, stating the terms clearly, visibly and in writing in advance. The same applies if the establishment offers the possibility of issuing a voucher. In this case, the terms, particularly the validity period, must be stated on the voucher itself.
On the other hand, the establishment will be required to exchange the products or give you a refund if:
- the product is defective. The consumer will have the right to choose between its repair or a replacement, provided that this is possible and proportionate.
- due to the type of sale, the customer has a right of withdrawal. In this case, the product can be returned within 14 days after the sale and the consumer can request a refund.
- it is expressly stated in the offer, promotion, advertising of the establishment or even the proof of purchase.
