Application of Decree Law 3/2023 to Tourist-Use Flats (HUTs)
Decree Law 3/2023, of 7 November, on urgent measures regarding the urban planning regime for tourist flats, issued by the Government of Catalonia, classifies Barcelona as a municipality with a strained housing market requiring an analysis and adjustment of the tourist accommodation supply.
The application of this decree will result in the elimination of all tourist-use flats (HUTs) in the city, which will have a significant impact on the availability of residential housing.
With the entry into force of Decree Law 3/2023, of 7 November, on urgent measures regarding the urban planning regime for tourist flats, issued by the Government of Catalonia, an analysis and adjustment of the tourist accommodation supply in Barcelona is required. The application of this decree will result in the elimination of all tourist-use flats (HUTs) in the city, which will have a significant impact on the availability of residential housing. The City Council of Barcelona plans not to renew the 10,000 tourist flat licences that will expire in 2028.
Three years earlier, in 2025, the City Council will begin the review of the current Special urban development plan for tourist accommodation (PEUAT), which defines and regulates the tourism offer.
The review will be based on the analysis of the following factors:
- Impact of the floating population
- Impact of tourism on public spaces
- Urban characteristics of the urban fabric
