The OMIC continues to provide its services to the public electronically and through the 010 phone service. Claims and enquiries will continue to be preferably dealt with online. For those inquiries or complaints that require face-to-face attention, you must make an appointment in advance on the municipal procedures portal ajuntament.barcelona.cat/cita/omic, by calling 010, or at the Municipal Procedures Kiosk.
Product warranty
When a consumer buys a product and it is defective or not working properly, the consumer has recognised rights: the legal warranty. New products generally have a legal warranty of two years. This may be shorter for second-hand products, but never less than one year from the date of delivery.
To prove that the product is under warranty, you must keep the receipt or invoice from the purchase. It is very important that you always keep these documents and that you retain the originals and provide only copies if requested by the seller.
In the event of a defect or malfunction, you can rely on the warranty and choose between the free repair of the product or its replacement at no cost (without any additional costs such as shipping costs) with an identical or similar product. However, you will need to report the incident as soon as possible because:
- if it is identified within the first six months after the purchase, the defect is deemed to be of origin and the burden to prove otherwise is on the seller;
- if it arises after six months, the consumer must prove that the defect is of origin rather than due to misuse. In this latter case, the company will repair it but without bearing the costs of travel or labour.
Finally, if the seller or manufacturer refuses to honour the warranty, you must make a claim against the company and, if you do not receive a satisfactory response, you should contact the OMIC.
